Part A - Introduction

1. Acceptance of Terms

1.1 These Terms and Conditions (this “Agreement”) govern your access to and use of the Homefix website, mobile application, and related digital platforms (collectively, the “Platform”) and your purchase of products through the Platform.

1.2 “Homefix,” “we,” “us,” and “our” mean Homefix and its affiliates, subsidiaries, successors, and assigns. “You” and “User” mean any person who accesses or uses the Platform. “Consumer” means a User who qualifies as a consumer under the Consumer Protection Act, 2002 (Ontario).

1.3 By accessing the Platform, creating an account, or placing an order, you agree to this Agreement. If you do not agree, do not use the Platform.

1.4 This Agreement does not limit any right or remedy a consumer has under the Consumer Protection Act, 2002 (Ontario), the Sale of Goods Act (Ontario), or any other law that cannot be waived by agreement. Where a provision of this Agreement conflicts with a non-waivable consumer right, the non-waivable right governs.

2. Eligibility

2.1 You must be at least 18 years old and capable of forming a binding contract under Ontario law to use the Platform or place an order.

2.2 You represent that all information you provide to Homefix is accurate, current, and complete.

Part B - Intellectual Property and Platform Use

3. Intellectual Property Rights

3.1 The Platform, including all text, graphics, logos, images, software, product descriptions, and related content, is owned by or licensed to Homefix and is protected under Canadian and international intellectual property law.

3.2 Homefix grants you a limited, revocable, non-transferable, non-exclusive licence to access and use the Platform for personal, lawful purposes connected to purchasing products from Homefix.

3.3 You will not:

  • Copy, reproduce, distribute, republish, transmit, sell, or otherwise exploit Platform content without Homefix’s prior written consent
  • Use bots, scrapers, crawlers, or other automated tools to extract data from the Platform
  • Modify, reverse engineer, or create derivative works based on the Platform
  • Use Homefix trademarks, logos, or trade names without prior written authorization

3.4 All trademarks, logos, and trade names appearing on the Platform remain the property of Homefix or their respective owners. No licence to any intellectual property is granted except as expressly stated in this Agreement.

4. Acceptable Use

4.1 You will not:

  • Use the Platform for an unlawful, fraudulent, misleading, or abusive purpose
  • Misrepresent your identity or authorization
  • Interfere with the security or operation of the Platform
  • Attempt unauthorized access to an account or system
  • Upload malicious code or viruses
  • Place an unreasonable demand on Homefix’s infrastructure

4.2 Homefix may suspend, restrict, or terminate a User’s access to the Platform where it reasonably suspects misuse, fraud, or a breach of this Agreement.

5. Account Registration and Security

5.1 You are responsible for keeping your account credentials confidential and for all activity occurring under your account.

5.2 Notify Homefix immediately at info@homefix.ca if you suspect unauthorized use of your account.

5.3 Homefix may suspend or terminate an account where it reasonably believes the account has been compromised, used fraudulently, or used in breach of this Agreement.

Part C - Products, Orders, and Pricing

6. Product Information

6.1 Homefix aims to provide accurate and current information about its products, including specifications, pricing, availability, and compatibility. Homefix does not guarantee that all product information is complete, accurate, or free of error.

6.2 Some Platform content, including product descriptions, recommendations, search results, and customer support responses, may be generated or assisted by artificial intelligence (“AI”). AI-assisted content may contain errors, omissions, or outdated information and should not be relied on as the sole basis for a purchasing, installation, or safety decision.

6.3 You are responsible for independently verifying product specifications, dimensions, compatibility, safety instructions, manufacturer guidelines, applicable building codes, and permit requirements before purchasing or using a product.

6.4 Nothing on the Platform constitutes professional engineering, construction, electrical, plumbing, legal, financial, or safety advice unless Homefix states otherwise in writing.

6.5 Homefix may correct, update, or remove product information at any time, including after an order is placed. If a correction materially affects an order you have placed, Homefix will notify you and give you the option to cancel that order for a full refund.

7. Pricing and Payment

7.1 Prices are stated in Canadian dollars unless stated otherwise and may exclude applicable taxes, duties, and delivery charges, which will be disclosed before you complete an order.

7.2 If a product is listed at an incorrect price because of a typographical, technical, or pricing error, Homefix may cancel the order, notify you, and refund any amount paid in full. Homefix is not obligated to honour an incorrect price.

7.3 By submitting payment information, you authorize Homefix to charge your payment method for the total amount of your order, including applicable taxes and delivery charges.

7.4 Homefix may require full or partial pre-authorization of payment before processing an order.

Part D - Internet Agreement Disclosure

8. Internet Agreements

8.1 An order placed through the Platform is an “internet agreement” under the Consumer Protection Act, 2002 (Ontario) where your total payment obligation exceeds $50.

8.2 Before you complete an order of more than $50, Homefix will disclose to you:

  • Homefix’s legal name, business name, address, telephone number, and email address
  • A fair and accurate description of the goods, including any applicable technical requirements
  • An itemized price for each item, including taxes and shipping charges
  • A description of any additional charge, such as duties or brokerage fees
  • The total amount payable
  • Accepted payment methods and terms
  • The estimated delivery date and delivery location
  • The delivery method and carrier, where applicable
  • Any cancellation, return, or refund right beyond those described in this Agreement
  • The currency of the transaction, if not Canadian dollars

8.3 Before you submit payment, Homefix will give you an express opportunity to review your order, correct an error, and accept or decline the agreement.

8.4 Homefix will deliver to you a written order confirmation by email, containing your name, the date of the order, and the information described in section 8.2, within 15 days of your order.

8.5 You may cancel your order:

  • At any time before delivery, and for up to 7 days after you receive your order confirmation, if Homefix did not provide the disclosure described in section 8.2 or the opportunity described in section 8.3
  • Within 30 days of placing your order, if Homefix does not deliver the order confirmation required under section 8.4

8.6 The cancellation rights described in this section are in addition to, and do not replace, the Return Policy in section 9 or any other right available to you by law.

Part E - Returns, Delivery, and Risk

9. Returns, Exchanges, and Refunds

9.1 Except as set out in this section, as required under section 8, or as required by law, sales made through the Platform are final.

9.2 You may return a product within 15 days of delivery if it is unused and in its original packaging, accompanied by proof of purchase, for a refund or exchange, less any restocking or delivery fee disclosed to you at the time of sale.

9.3 Homefix does not accept the return of a special-order item, custom-made product, clearance or final-sale item, or a product damaged through misuse or unauthorized modification.

9.4 Nothing in this Agreement excludes or limits a condition, warranty, or remedy that cannot be waived by a consumer under the Sale of Goods Act (Ontario) or the Consumer Protection Act, 2002 (Ontario), including the deemed conditions that goods are of merchantable or reasonably acceptable quality and fit for their intended purpose. If a product you purchase is defective or does not match its description, contact Homefix at info@homefix.ca with your order number, a description of the issue, and supporting photos, and Homefix will assess your claim under applicable law.

10. Delivery

10.1 Delivery dates are estimates. Homefix is not liable for a delay caused by circumstances beyond its reasonable control, including weather, carrier delay, or supply shortage.

10.2 Risk of loss or damage to a product passes to you on delivery to the address you provided.

10.3 If Homefix cannot deliver a product within the time disclosed under section 8.2, you may cancel the affected order for a full refund.

Part F - Content, Third Parties, and Liability

11. User-Submitted Content

11.1 If you submit a review, photo, or other content to Homefix, you grant Homefix a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display that content in connection with operating and promoting the Platform.

11.2 You represent that you own or control the rights to content you submit and that it does not infringe a third party’s rights or violate a law.

11.3 Homefix may remove or refuse submitted content at its discretion.

12. Third-Party Links

12.1 The Platform may link to third-party websites or services. Homefix does not control and is not responsible for third-party content, privacy practices, or security.

13. Disclaimers and Limitation of Liability

13.1 The Platform is provided on an “as is” and “as available” basis. To the extent permitted by law, Homefix disclaims all warranties regarding the Platform’s operation, including that it will be uninterrupted, secure, or free of error.

13.2 To the extent permitted by law, Homefix is not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profit, revenue, or data, arising from your use of the Platform or a product purchased through it.

13.3 Homefix’s total liability for a claim relating to a product is limited to the amount you paid for that product. This limit does not apply to a claim that cannot be limited under the Consumer Protection Act, 2002 (Ontario) or the Sale of Goods Act (Ontario).

13.4 Nothing in this section excludes or limits Homefix’s liability for death, personal injury, or property damage caused by its negligence, or any other liability that cannot be excluded under Ontario law.

14. Indemnification

14.1 You agree to indemnify and hold Homefix harmless from a claim, loss, or expense, including reasonable legal fees, arising from your breach of this Agreement, your misuse of the Platform, or content you submit, except to the extent caused by Homefix’s own negligence or wilful misconduct.

Part G - Privacy, Disputes, and General Terms

15. Privacy

15.1 Homefix’s collection, use, and disclosure of your personal information is governed by the Homefix Privacy Policy, available on the Platform.

15.2 By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy and in accordance with the Personal Information Protection and Electronic Documents Act (Canada).

16. Dispute Resolution and Governing Law

16.1 This Agreement is governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.

16.2 A dispute arising from this Agreement is subject to the jurisdiction of the courts of Ontario.

16.3 If you are a consumer under the Consumer Protection Act, 2002 (Ontario), nothing in this Agreement requires you to submit a dispute to arbitration before the dispute arises, and nothing prevents you from commencing or joining a class proceeding under the Class Proceedings Act, 1992 (Ontario) in respect of a dispute arising from this Agreement. After a dispute arises, you and Homefix may agree in writing to resolve it by arbitration or another process under the Arbitration Act, 1991 (Ontario).

16.4 If you are not a consumer under the Consumer Protection Act, 2002 (Ontario), Homefix and you may agree to resolve a dispute through binding arbitration administered in Ontario under the Arbitration Act, 1991 (Ontario), in place of court proceedings.

17. General Provisions

17.1 Entire Agreement. This Agreement, together with the Privacy Policy, is the entire agreement between you and Homefix regarding the Platform and supersedes any prior agreement on the same subject.

17.2 Severability. If a provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in effect.

17.3 No Waiver. Homefix’s failure to enforce a provision of this Agreement is not a waiver of its right to do so later.

17.4 Assignment. Homefix may assign this Agreement in connection with a merger, acquisition, or sale of assets. You may not assign this Agreement without Homefix’s written consent.

17.5 Notices. Homefix may give you notice by email, through the Platform, or by mail to the address on file for your account.

18. Changes to This Agreement

18.1 Homefix may revise this Agreement at any time. A revised Agreement applies to an order placed after it is posted on the Platform and does not apply retroactively to an order placed before the revision.

18.2 Continued use of the Platform after a revision is posted means you accept the revised Agreement.
